Smith, Chapman & Campbell to File Lawsuit to Stop Enforcement of HR 4040, the Consumer Product Safety Improvement Act of 2008

In August of 2008, the US House of Representatives passed HR 4040, the Consumer Product Safety Improvement Act of 2008 (the "Act") to protect children from lead poisoning. However, the Act is so broadly worded so as to put out of business many small and medium sized businesses that have never manufactured or sold a dangerous product. Smith, Chapman & Campbell is working on filing a complaint to stop the devastating consequences of this act.

The Act will require mandatory testing and certification of all products designed to be used by children under 12 years of age. The cost of such testing and certification may be devastating to many small and medium sized businesses.
